"TENDER INFORMATION NOTICE FOR THE PROVISION OF (FINANCIAL, TECHNICAL AND LEGAL) ADVISORY SERVICES FOR THE IMPLEMENTATION A MODEL FLIGHT SIMULATOR CENTRE VIA A PUBLIC - PRIVATE PARTNERSHIP"

BRIEF DESCRIPTION OF THE CONTRACT:The scope of the advisor?s services is general support for the Contracting Authority during the procedure to prepare and finalise the optimum form of Partnership and to select the most suitable private sector partner who will undertake, as part of the PPP, the design, financing, building, maintenance and facility management of building infrastructure and the necessary equipment at the model flight simulator centre and to provide simulator-based pilot training services both to the Contracting Authority and third parties (whether public sector bodies or Greek or foreign users) in the context of the scope hereof and the requirements laid down by the Contracting Authority with the Advisor's assistance. 

The basic sectors in which advisory services will be provided include:
- Finalising the business plan taking into account alternative sites, including the proposal on the type of tendering procedure, the partnership form, its basic parameters, risk allocation and value for money for the Contracting Authority.
- preparing, finalising and refining the technical specifications for the scope of the approved partnership which will include the construction specifications for building facilities, and the construction or supply specifications for the necessary equipment, the maintenance, facility management and supply specifications for all services including replacement and maintenance, and the supply specifications for training services in accordance with the PPP contract requirements.
- preparing the minimum availability requirements and project operational features, which shall be connected to the availability payments.
- drawing up tender notices and other documents for the selection of the PSP, including the designation of tender evaluation criteria, and providing clarifications to Tenderers, as well as advisory services during the evaluation of the Tenderers.
specifying the terms of the contracts to be concluded and providing advisory services and participating in any negotiations or consultations with potential private sector partners.
-transferring know-how to the Contracting Authority and the Greek State in general relating to all the foregoing issues and in particular in relation to monitoring implementation of the scope of contract and quality assurance

BUDGET: 1.200.000 maximum (VAT excluded). The Contracting Authority keeps the option to assign the Advisor new services consisting in the repetition of similar contract services, pursuant to art. 31, par. 4b of the Directive 2004/18/EC.

CONDITIONS FOR VALID PARTICIPATION: In the tender are entitled to participate physical or legal entities, independently or in consortium or in joint venture, that is/are already or will be established,
(a) operating mainly in the field of services, as those referred to in art. 3 of the Notice and fall into the categories 6, 7, 11 and 12 of annex IIA, as well as the category 21 of annex IIB of the directive 2004/18/EC, if themselves or any of their members (in the case of consortium or joint venture):
1. Are registered in the Greek Designer Register or Design Office Register and, particularly, have at least the following Designer Certificate:
a) D or E Class in category 06 "Architectural designs of building projects"
b) D or E Class in category 08 "Static Designs"
c) D or E Class in category 09 "Mechanical, Electrological and Electronic Designs" 
2. Or come from countries members of EU, or EEA, or countries that have ratified the agreement for public contracts of the World Trade Organization and which keep equivalent registers, according to art. 52 of the directive 2004/18/EC, and are registered in classes and categories of designs or services corresponding to those of the above par. 1,
3. Or come from countries members of EU, or EEA, or countries that have ratified the agreement for public contracts of the World Trade Organization but which do not keep registers such as those mentioned in the previous paragraphs, and are registered in the Professional/Trade Registers of Annex IX C of the Directive 2004/18/EK or in the equivalent registers of their countries, and have general experience corresponding to this resulting from the registration in the Designer Register or Design Office Register, i.e. executive work force with experience in equivalent design categories
b. The legal advisors should be registered in the local Bar Association.
c. The participants should fulfill the following minimum levels of financial adequacy:
(1) Average turnover over the three last economic years, over 6.000.000, to be proven by published balance sheets
(2) Average turnover of the financial member/s of the consortium or joint venture of the tenderer in the financial field (corporate finance, project finance etc) over the three last economic years, over  3.000.000, to be proven by published balance sheets or by the submitted relevant solemn declarations.
In the case of a consortium or joint venture, the weighted average turnover mentioned above, shall be taken into account, for the three last economic years, on the basis of each member's participation rate in the consortium or joint venture, provided that these members operate in the provision of services related to the subject of this tender.

In the case that entities participating in the tender operate for less than three years, the average turnover of these years' operation shall be taken into account.
d. All the tenderers are obliged to undertake in writing the obligation to protect the confidentiality of the information made known to them during or on the occasion of this tender.
e. Each physical or legal entity is entitled to participate only in one contesting scheme, individually or as partnership member or as joint venture member. In the contrary case, all tenderers with this person in their scheme shall be excluded from the procedure.

EFFECTIVE TERM OF CONTRACT: twelve (12) months from the signing of the Contract.

ADMISSION OR PROHIBITION OF VARIANTS: Variants are prohibited.

APPLICABLE LAW: L. 3389/2005 (GOJ A 232), L. 3483/2006 (GOJ A 169), art. 16 par. 1, P.D. 60/2007 (GOJ A  64), Directive 2004/18/EC and Directive 89/665/EC.

COST FOR THE PROVISION OF THE DOCUMENTS AND PAYMENT TERMS: Each party concerned can receive the abovementioned documents paying the amount of 15 euros. A translated version in English is also provided, at the cost of 300 euros. 

DEADLINE FOR THE SUBMISSION OF TENDERS: Tuesday, 30.06.2009, at 10.00 a.m. at 229-231 Mesogeion Av., Athens - Greece, p.c. 154 51.

DATE FOR THE OPENING OF TENDERS: Tuesday, 30.06.2009, at 10.00 a.m., at the Premises of the Supporting Unit of the Ministry of National Defence, 229-131 Mesogeion Av., p.c. 154 51, tel: 210 6598393, fax: 210 6422208. Candidates or their representatives (on the basis of a written authorisation) may be present at the opening of the Tenders.

GUARANTEES: Participation guarantee of  60.000 euros. Performance Bond, equal to 10% of the financial subject of the contract.

BASIC TERMS OF FINANCING: The Contract shall be financed from the Public Investments' Program.

CONDITIONS FOR VALID PARTICIPATION: art. 11, 12 and 14 of the Tender Notice

VALIDITY PERIOD OF TENDERS: Nine (9) months, beginning from the next day of the deadline for submission of Tenders.
 
CONTRACT AWARD CRITERION: The most economically advantageous tender, according to the criteria described in the Tender Notice.

APPEALS: according to the provisions of L. 2522/1997
