The Secretariat General of Sports of the Ministry of Culture announces a public
tender with open procedure for the selection of a contractor for the provision of advisory services
for the implementation of 11 sport centres and 13 swimming centres through a PPP scheme. According
to the decision of the Greek Inter-ministerial Committee for PPPs (DESDIT) dated 01.09.2008, this
tender shall be conducted pursuant to art. 6 par. 4 of L. 3389/2005, as amended by art. 16 par. 1
of L. 3483/2006 (GOJ A 169) and is governed by the provisions of directives 2004/18/EC of the
European Parliament and the Council, of 31 March 2004 (L 134, 30/04/2004), which was incorporated
to the Greek Legislation by P.D. 60/2007 (GOJ A 64) and 89/665/EEC, of 21 December 1989 (L395,
30/12/1989, Law 2522/1997).
SCOPE: The scope of Advisory services is to support the Contracting Authority (Secretariat
General of Sports), during the procedure to prepare and finalise the optimum form of partnership
and to select the most suitable SPV who, as part of the PPP project, will undertake the design,
financing, construction, maintenance, and insurance of 11 sports centres and 13 swimming centres,
in the context of the contractual scope and the requirements laid down by the Contracting Authority
with the assistance of the Advisor.
BUDGET: 750.000,00 (VAT excluded). Payment will follow the completion of the
various phases of the project.
PLACES FOR THE PROVISION OF SERVICES: Athens, and the areas where the sports
infrastructure will be implemented. Greece.
LANGUAGE: Greek.
CONDITIONS FOR VALID PARTICIPATION: In the tender are entitled to participate
physical or legal entities, independently or in consortium or in joint venture, that is/are already
or will be established, operating mainly in the field of services, as those referred to in art. 3
of the Notice and fall into the categories 6, 11 and 12 of annex IIA, as well as the category 21 of
annex IIB of the directive 2004/18/EC, if themselves or any of their members (in the case of
consortium or joint venture):
1. Are registered in the Greek Designer Register or Design Office Register and, particularly,
have at least the following Designer Certificate:
a) C, D or E Class in category o6 'Architectural designs of building projects'
b) D or E Class in category 08 'Static Designs? ´
c) C, D or E Class in category 09 'Mechanical, Electrological and Electronic Designs'
2. Or come from countries members of EU, or EEA, or countries that have ratified the
agreement for public contracts of the World Trade Organization and which keep equivalent registers,
according to art. 52 of the directive 2004/18/EC, and are registered in classes and categories of
designs or services corresponding to those of the above par. 1,
3. Or come from countries members of EU, or EEA, or countries that have ratified the
agreement for public contracts of the World Trade Organization but which do not keep registers such
as those mentioned in the previous paragraphs, and are registered in the Professional/Trade
Registers of Annex IX C of the Directive 2004/18/EK or in the equivalent registers of their
countries, and have general experience corresponding to this resulting from the registration in the
Designer Register or Design Office Register, i.e. executive work force with experience in
equivalent design categories
4. The legal advisors should be registered in the local Bar Association.
5. The participants should fulfil the following minimum levels of financial adequacy:
(a) Average turnover over the three last fiscal years, over 5.000.000, to be proven by
published balance sheets or by the submitted relevant solemn declarations.
(b) Average turnover of the financial member/s of the consortium or joint venture of the
tenderer in the financial field (corporate finance, project finance etc) over the three last fiscal
years, over 2.000.000, to be proven by published balance sheets or by the submitted relevant solemn
declarations.
In the case of a consortium or joint venture, the weighed average turnover mentioned above,
shall be taken into account, for the three last fiscal years, on the basis of each member?s
participation rate in the consortium or joint venture, provided that these members operate in the
provision of services related to the subject of this tender.
In the case that entities participating in the tender operate for less than three years, the
average turnover of these years? operation shall be taken into account.
In the case of a newly established legal entity, submission of provisory balance sheets or
any other document in proof of the financial situation of the tenderer (e.g. bank certificates,
professional risks insurance certificates, solemn declaration of other operators, whose capacities
the tenderer relies on, for their relevant commitment) is mandatory, from which the average
turnover of its operation period shall result.
In the case of tenderers, that are not subject to the obligation of balance sheet publication
according to the law, it is obligatory that they submit a solemn declaration with regard to their
financial situation comprising all the above data.
Each physical or legal entity is entitled to participate only in one contesting scheme,
individually or as partnership member or as joint venture member. In the contrary case, all
tenderers with this person in their scheme, shall be excluded from the procedure.
Every tenderer should have in addition specific technical and professional ability as defined
in art. 11 of the Notice, namely, experience either in the implementation or in the provision of
advisory services with regard to a building infrastructure project via private financing
(technical, financial or legal issues).
EFFECTIVE TERM OF CONTRACT: twenty four (24) months. The Contracting Authority may
extend unilaterally the contract?s duration, beyond 24 months (or 30 months in the case where
services are suspended). The extension shall not entitle the Advisor to any extra fee, on condition
that the unilateral extension does not exceed a total of 36 months from the contract signing date.
In all events, the contract shall be automatically terminated if the said period of 36 months from
the contract signing date elapses and a new extension has not been agreed in writing by the
contracting parties.
SELECTION CRITERIA: The most economically advantageous tender.
PARTICIPATION GUARANTEE: 37.500,00 euros
